1. Introduction
Welcome to thePumpkinSchool.com, operated by Guts and Seeds Inc. These Terms and Conditions apply to our website, our stencils and carving materials, and Pumpkin Studio, our app for turning photos into pumpkin carving stencils.
By using this website or Pumpkin Studio, you accept these terms in full. If you do not agree to them, please do not use the website or the app.
2. Who Can Use Pumpkin Studio
- If you are under the age of majority where you live, a parent or guardian must agree to these terms on your behalf and supervise your use of Pumpkin Studio.
- Teachers may use Pumpkin Studio and our stencils with their students for non-commercial classroom teaching, including showing students’ designs in class.
3. How Pumpkin Studio Handles Your Photos
- Photos you upload into Pumpkin Studio are processed on your own device, in your browser. We do not upload or store them on our servers while you design.
- Your project is saved as a .pmpkn file on your device, and as an automatic backup in your browser. Keep your .pmpkn files somewhere safe: we do not keep copies of them, and they are how you bring a design back to reprint it.
- We keep your account details, your purchase records, and a record of which stencils your account can access, so your purchases work every time you visit.
- The one exception is sharing. If you choose to share a stencil to the community stencil library (section 6), your project, including your photo, is uploaded to our servers and becomes visible to other users.
4. License to Use Stencils, Prints and Share Images
Stencils and decoration prints from this website and Pumpkin Studio are for personal, non-commercial use only. You may:
- Download, print and carve stencils to decorate pumpkins for yourself, your family and your friends.
- Download your Share it image and share it on social media and with friends and family.
- Use them for non-commercial classroom teaching (section 2).
You may not:
- Sell, resell, or use our stencils, prints or share images for commercial purposes.
- Distribute our stencils, or other users’ community stencils, on any other website or platform, whether free or paid.
- Remove or hide the Pumpkin School branding on share images, stencils or prints.
5. Your Photos and Your Rights
You keep ownership of the photos you upload. By uploading a photo to Pumpkin Studio, you confirm that:
- You own the photo, or you have permission to use it. A photo you found online usually belongs to the photographer, even if you are allowed to view it.
- You have permission from any recognizable person in the photo. If that person is under the age of majority, you have permission from their parent or guardian.
- You will not share a stencil of a celebrity or other public figure without their permission. For example, you may not share a stencil made from a photo of Beyoncé to the community library. A famous person’s image is protected, and so is the photographer’s copyright.
- You will not share stencils of copyrighted characters, logos or artwork that you do not have the rights to. Carving your own pumpkin at home is one thing; publishing the design for others is another.
You are responsible for the photos you upload and the stencils you share.
6. Sharing to the Community Stencil Library
Sharing is optional. When you share a stencil:
- What is uploaded: your project file (including your cropped photo), a preview image, the title, description, categories and carving style you choose, and your display name.
- Who can see it: other Pumpkin Studio users can browse it, load it, see the photo, carve it, and create their own versions of it.
- The license you give us: you grant Guts and Seeds Inc. a permanent, worldwide, non-exclusive, royalty-free license to host, display and use your shared stencil, including for commercial purposes, such as making it available to other users, featuring it on thePumpkinSchool.com, and promoting Pumpkin Studio, with credit to your display name. You keep ownership of your photo and design.
- Remixes: other users may create new versions of your stencil in different carving styles and share them. Their versions credit you as the original creator.
- Removing it: you can delete your shared stencil at any time, and it will no longer appear in the community library. If it was featured on thePumpkinSchool.com and you ask us, we will remove the featured page too. Copies other users already downloaded, printed or carved may remain in their hands.
We may review, hide, edit the details of, or remove any shared stencil at any time, for any reason, including if other users report it.
7. Content Rules
Do not upload or share anything that:
- You do not have the rights to use (section 5).
- Is sexual, violent, hateful, harassing or threatening.
- Mocks, bullies or embarrasses another person, or shares someone’s private information.
- Is illegal, or encourages illegal activity.
Users can flag stencils they believe break these rules. Flagged stencils may be hidden automatically while we review them.
8. Display Names and Credit
Your display name may appear on your share image (“designed by”), on your printed stencils (“Designed by”), and on stencils you share to the community library.
- Choose a name you are comfortable having others see. A first name or nickname works best; we recommend children do not use their full name.
- Do not use a name that is offensive, or that pretends to be someone else.
- We automatically filter display names, and may reject any name or change it back to the default, at our discretion.
The number of choices shown on a share image (for example, “after 38 choices of light, dark and detail”) counts the adjustments made in Pumpkin Studio while designing. It is a fun measure of the work that went into a design, not a guarantee of originality.
9. Our Promise About Children’s Faces
We will never use a stencil, share image or photo showing a child’s face on our website or in our marketing without permission from that child’s parent or guardian. This applies even to stencils shared to the community library.
10. Photos You Send Us
We love seeing your carved pumpkins. If you email us photos, for example in reply to our after-Halloween email, we will only use them on our website or in our marketing if you tell us we may. If a child appears in the photo, a parent or guardian must give that permission.
11. Reporting a Problem or Copyright Concern
If you believe a shared stencil uses your photo, your likeness or your copyrighted work without permission, or otherwise breaks these terms, email our designated contact at support@thepumpkinschool.com with the subject line “Content report”, and include:
- The stencil’s title or a link to it, and a description of the problem.
- Your name and contact details.
- For copyright or likeness concerns: a statement that you own the rights (or are authorized to act for the owner), and that the use is not authorized.
We review every report, may hide the stencil while we look into it, and remove content that breaks these terms. We may end the sharing privileges of users who repeatedly share content they do not have the rights to.
12. Your Responsibility for Content You Upload
You agree to cover (indemnify) Guts and Seeds Inc. against any claims, losses, damages and costs, including reasonable legal fees, that arise from photos or content you upload or share, or from your breaking these terms. If you are under the age of majority, your parent or guardian accepts this responsibility on your behalf.
13. Accounts
By creating an account, you agree to:
- Provide accurate information, including a working email address.
- Keep your login details confidential and not share your account with others. An account may be used on a limited number of devices.
- Use stencils and prints in accordance with these terms.
14. Purchases and Access
- Pumpkin Studio Carver is a one-time payment for 9 months of full access, including unlimited stencils from your own photos and the community stencil library. It does not renew automatically. Renewing early adds 9 months to your current access. Every stencil you create or open during your access period is yours to keep and reprint, even after your access ends.
- Single Carve is a one-time payment for one stencil and its decoration print, which you can reprint any time.
- “Permanent” and “keep” mean for as long as we operate Pumpkin Studio. Stencils you have downloaded or printed are always yours to keep.
- Prices are shown at checkout. Payments are processed securely by Stripe; we never see or store your card number.
15. Refunds
If you are not fully satisfied with a purchase, email support@thepumpkinschool.com within 7 days of purchase, from the email address on your account, and we will refund you in full.
- Refunds go back to the original payment method. Your bank may take up to 10 business days to show it.
- A refund ends the access that purchase gave you: for Pumpkin Studio Carver, your 9 months of access; for Single Carve, access to that stencil.
- October is our busiest time of year. Refund requests received from October 25 to October 31 will be processed by November 15.
- Purchases made with a 100% discount code have no payment to refund.
16. Emails
We send emails about your account and purchases. We may also send occasional emails about Pumpkin Studio and pumpkin carving, such as carving tips, seasonal offers, and a short survey after Halloween. Every marketing email includes an unsubscribe link, and you can unsubscribe at any time.
17. Carving Safety
Pumpkin carving involves sharp tools. Children should always carve with adult supervision. Use carving tools carefully and as intended, and never leave a lit candle unattended. You carve at your own risk.
18. Intellectual Property Rights
Pumpkin Studio, our stencils, carving guides, book and all other materials on this website, other than content shared by users, belong to Guts and Seeds Inc. Unless otherwise stated, all rights are reserved. The Pumpkin School™ and Pumpkin Studio™ are trademarks of Guts and Seeds Inc.
19. Limitation of Liability
thePumpkinSchool.com and Guts and Seeds Inc. are not responsible for any loss, injury or damage arising from the use or misuse of the website, Pumpkin Studio, our stencils, or content shared by other users. We provide these as-is, and make no guarantees about their suitability for any purpose.
20. Termination of Access
We may suspend or end your access to the website, Pumpkin Studio, or community sharing at any time, without notice, including if you break these terms.
21. Governing Law
These terms are governed by the laws of British Columbia, Canada, and you submit to the exclusive jurisdiction of the courts there.
22. Changes to These Terms
We may revise these terms at any time. The “Last updated” date at the top shows when they last changed. By continuing to use the website or Pumpkin Studio, you accept the current terms.
